Brazil betting ban challenged in Supreme Court hearing

Brazil's Supreme Federal Court is holding a public hearing to address controversies surrounding Provisional Measure 1.394/2026, which bans fixed-odds betting and cancels active authorizations, drawing diverse stakeholders including football clubs and sports authorities.

Brazil betting ban challenged in Supreme Court hearing

An exceptionally diverse collection of stakeholders is preparing to address Brazil’s Supreme Federal Court (STF) regarding the ongoing controversy surrounding fixed-odds betting. Football clubs, national sports authorities, government agencies, and gambling associations are all slated to share their perspectives on November 3.

Convened by Justice Luiz Fux, this public session will afford 28 chosen entities a brief window to discuss the consequences of Provisional Measure 1.394/2026. This specific measure outlaws fixed-odds betting and cancels active authorizations, triggering multiple legal disputes currently under judicial review.

Instead of restricting involvement solely to the parties directly connected to the active litigation, the session gathers representatives from across the athletic, public administration, and wagering industries. Every invited organization is allotted 10 minutes to present.

Football Organisations Take a Prominent Place

Among the participants called to testify are prominent football clubs such as Flamengo, Fluminense, Botafogo, Cruzeiro, São Paulo, and Corinthians, alongside the Brazilian Football Confederation (CBF) and the Brazilian Olympic Committee (COB).

The timeline sets the football clubs’ presentations right after Fux delivers his opening statements, with the CBF and COB following closely behind.

State agencies will also offer testimony. The Attorney General’s Office (AGU) takes the floor in the post-lunch session, succeeded by the Ministry of Finance and the Ministry of Sport. The Office of the Prosecutor General is included on the roster as well.

Additional participants on the agenda feature the National Confederation of Commerce (CNC), National Confederation of Industry (CNI), Able, Abert, and UERJ Reg.

Betting Associations Given Afternoon Slots

The wagering industry will find its voice through the National Association of Games and Lotteries (ANJL) and the Brazilian Institute for Responsible Gaming (IBJR). Both groups are slated to take the stand in the afternoon block between 3 p.m. and 3:20 p.m.

Through ADI 8027, ANJL has formally challenged the provisional measure, pushing for its swift suspension alongside a formal ruling declaring it unconstitutional. Furthermore, the association asks the STF to maintain the validity of existing legislation governing fixed-odds betting.

Additional legal opposition to the measure comes via ADIs 8024, 8028, and 8035. Meanwhile, separate legal actions—specifically ADIs 7721, 7723, and 7749—target Law 14.790/2023, widely recognized as the Bets Law. All of these matters fall under the jurisdiction of Justice Fux.

The International Gaming Association appears near the end of the lineup, with proceedings anticipated to wrap up near 5 p.m.

A Limited Window for Each Position

Proceedings get underway at 10 a.m. inside the STF’s Second Panel session room. Participating entities were required to send the names and legal powers of attorney for their delegates to adi8027@stf.jus.br no later than 3 p.m. on October 29, with a maximum of two representatives allowed per organization.

This upcoming session builds upon a previous STF public forum held in November 2024, which brought together upwards of 50 specialists, government institutions, and civil society delegates to debate obstacles facing Brazil’s wagering regulations.

Subsequently, the AGU petitioned the tribunal for another hearing, pointing to changing circumstances since the prior meeting, new evidence, and the introduction of the latest provisional measure. TV Justiça, Rádio Justiça, and the official STF YouTube channel will stream the November proceedings live.
